NOTICE IS HEREBY GIVEN that the Applicant in this Cause is requesting that the Commission pool as a unit and adjudicate the rights and equities of all oil and gas owners, pursuant to Title 52 O.S. §87.1, in the Cherokee common source of supply underlying Section 22, Township 19 North, Range 21 West, Ellis County, Oklahoma, to designate the Applicant or some other party as operator and grant said operator one-year in which to commence operations.
NOTICE IS FURTHER GIVEN that the Applicant in this Cause is requesting the following special relief: To authorize the Applicant or some other party to drill said well, provide that the operator have one-year in which to commence operations and possibly make this Order effective on a date prior to the signing thereof.
NOTICE IS FURTHER GIVEN that this Cause will be heard before an Administrative Law Judge on the Conservation Docket at the Corporation Commission, Eastern Regional Office, 201 W. 5th St, Tulsa, Oklahoma 74103, at 8:30 a.m., on the 24th day of November, 2025, and that this Notice be published as required by law and by the Rules of the Commission. If the offices remain closed, the hearing will be conducted via telephone and/or video conference.
NOTICE IS FURTHER GIVEN that the Applicant and interested parties may present testimony by telephone. The cost of the telephonic communication shall be paid by the person or persons requesting its use. Interested parties who wish to participate by telephone shall contact the Applicant or Applicant’s attorney prior to the hearing date and provide their name and phone number.
NOTICE IS FURTHER GIVEN that any party objecting to the place of hearing should file their objection with the Court Clerk not less than five (5) days before the initial scheduled hearing. Failure to make a timely objection to the location of the hearing may be deemed by the Commission as a waiver to the place of hearing or venue.
NOTICE IS FURTHER GIVEN that any interested persons may participate in the hearing by telephone. Instructions for participation and teleconference/video numbers will be posted on the Commission’s webpage, https://oklahoma.gov/occ.html, and sent out via the Commission’s GovDelivery service.

NOTICE IS HEREBY GIVEN that the Applicant has filed an Application, Cause CD No. 2025-003031, requesting that a 640-acre horizontal drilling and spacing unit be established for the Cherokee common source of supply underlying Section 22, Township 19 North, Range 21 West, Ellis County, Oklahoma.
NOTICE IS HEREBY GIVEN that the Cecil 1-22 API #045-21561, located in the NE/4 NE/4 of Section 22 & Beall 1-22 API #045-21546, located in the NE/4 SW/4 NE/4 of Section 22, are operated by Spess Oil Company and were producing from the Red Fork common source of supply pursuant to spacing Order No. 302162
NOTICE IS HEREBY GIVEN that OCC-OAC 165:5-7-6(h) requires that no order of the Commission authorizing a horizontal well unit that overlies any existing well or portion of an existing drilling and spacing unit producing from the same common source of supply will become effective until at least 50% of the ownership having a right to drill in each such well and/or drilling and spacing unit consents in writing to the horizontal well unit by filing such written consent with the Court Clerk of the Commission in such cause. Request for such consent must be sent by restricted mail to the owners having the right to drill in any existing well and/or drilling and spacing unit producing from the same common source of supply as the proposed horizontal well unit and Applicant has complied with this requirement.
NOTICE IS HEREBY GIVEN that Applicant has been unable to obtain 50% approval of the ownership in the Cecil 1-22 API #045-21561 & Beall 1-22 API #045-21546 in writing for a horizontal well unit for the Cherokee common source of supply as required by OCC-OAC 165:5-7-6(h).
NOTICE IS HEREBY GIVEN that Applicant requests that the Commission enter an order excepting Applicant to the 50% approval of ownership requirement to a horizontal well unit as stated in OCC-OAC 165:5-7-6(h).
NOTICE IS FURTHER GIVEN that this cause be set before an Administrative Law Judge for hearing, taking of evidence and reporting to the Commission.
