REPORT OF COMMISSIONERS
We, Rusty Royal, Tyke Greer, and Lisa Friesen, having been appointed Commissioners by the Order of the Court entered on October 23, 2025 to make partition between the Plaintiffs and the Persons and/or Trust(s) identified on Exhibit “A” of the surface estate in the following described real property situated in Ellis County, Oklahoma, to-wit:
The East Half of the Southwest Quarter (E/2SW/4), and the West Half of the Southeast Quarter (W/2SE/4) of Section Twenty-eight (28), Township Twenty-four (24) North, Range Twenty-three (23) West of the Indian Meridian, Ellis County, Oklahoma.
the (“Real Property”), hereby certify and report to the Court that before entering upon our duties as such Commissioners, we took and subscribed the Oath directed by the statute; that we then proceeded to view, inspect, and examine the above-described Real Property on November 25, 2025, for the purpose of making Partition thereof as ordered and directed by the Court.
We found that Partition of the Real Property, due to the diversity of ownership, could not be made among the parties according to their respective interest as determined and ordered by the Order of the Court herein, without manifest injury to the Parties.
Your Commissioners thereupon proceeded to appraise the surface estate in the above described Real Property for the sum of $185,000.00.

PLEASE TAKE NOTICE:
The Parties reference in the preceding paragraph will take notice that the Commissioners (Appraisers) appointed by the Court in the above-styled cause have filed their Report with the Ellis County Court Clerk on the 26th day of November, 2025, which Report states that a partition in-kind of the surface estate in the Real Property described herein CANNOT be made without manifest injury. The Commissioners have made an appraisement and valuation of the surface estate in the following described Real Property in the amount of $185,000.00, to-wit:

A copy of the Report is attached to this Notice.
All parties, and/or their attorneys of record, will further take notice that, pursuant to 12 O.S. §1509, the time limit for filing an Exception to the Commissioner’s Report and/or an Election to take the Subject Property at the appraised value is not later than twenty (20) days from the date the Report was filed with the Court. The Exception and/or Election shall be filed no later than December 16, 2025, with the Ellis County Court Clerk, P.O. Box 217, Arnett, OK 73858, with a copy to Sims, Price & Price, PLLC, P.O. Box 1086, Woodward, OK 73801.
