ORDINANCE NO. 2024-7
AN ORDINANCE VACATING A RIGHT OF WAY EASTMENT PREVIOUSLY
DEDICATED TO THE TOWN OF ARNETT, OKLAHOMA; PROVIDING THAT
INVALIDITY OF A PART SHALL NOT INVALIDATE THE REMAINDER;
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH
Be it ordained by the Town Board of the Town of Arnett, Oklahoma:
Section 1. Upon motion of the Town Board, it has determined that the following described tract of land which had previously been dedicated to the Town of Arnett as a public street, and that the same is no longer necessary for use by the public as a street, and should be closed, vacated and discontinued, said easement being described as follows:
All of that portion of Barnes Avenue lying adjacent to and between, Lot Six (6) of
Block Eight (8) of Collins First Addition to the Town of Arnett; and
Lot One (I) of Block Two (2) of Co II ins Second Addition to the Town of Arnett.
Section II. That said part of Barnes Avenue is hereby declared to be not necessary for the
use of the public as a street or for any other public use.
Section III. It is therefore declared that the following described portion of Barnes Avenue, described as follows:
All of that portion of Barnes Avenue lying adjacent to and between, Lot Six (6) of Block Eight (8) of Collins First Addition to the Town of Arnett; and
Lot One (I) of Block Two (2) of Collins Second Addition to the Town of Arnett,
is hereby closed, vacated, and discontinued, and reverts to the adjoining landowners in their proportionate ownership of the adjoining property.
Section IV. BE IT FURTHER ORDAINED that any part of provision or Section of this Ordinance that is declared illegal or unconstitutional shall not affect the other parts thereof.
Passed, Approved and Adopted by a unanimous vote of the members present at the regular meeting of the Town Board of said Town of Arnett, Oklahoma, held on this 25th day of February, 2026.
