NOTICE IS HEREBY GIVEN that the Applicant filed an Application, Cause CD No. 2025-003965T, requesting that a 640-acre horizontal drilling and spacing unit be established for the Cherokee common source of supply underlying Sections 23, Township 19 North, Range 21 West, Ellis County, Oklahoma.
NOTICE IS HEREBY GIVEN that the Jackson 1-23 (API# 045-22509), operated by Kepco Operating, Inc. is producing from the Red Fork common source of supply in 640 acre unit by Order No. 94923.
NOTICE IS HEREBY GIVEN that OCC-OAC 165:5-7-6(h) requires that no order of the Commission authorizing a horizontal well unit that overlies any existing well or portion of an existing drilling and spacing unit producing from the same common source of supply will become effective until at least 50% of the ownership having a right to drill in each such well and/or drilling and spacing unit consents in writing to the horizontal well unit by filing such written consent with the Court Clerk of the Commission in such cause. Request for such consent must be sent by restricted mail to the owners having the right to drill in any existing well and/or drilling and spacing unit producing from the same common source of supply as the proposed horizontal well unit and Applicant has complied with this requirement.
NOTICE IS HEREBY GIVEN that Applicant has been unable to obtain 50% approval of the ownership in the above listed wells in writing for a horizontal well unit for the Cherokee common source of supply as required by OCC-OAC 165:5-7-6(h).
NOTICE IS HEREBY GIVEN that Applicant requests that the Commission enter an order excepting Applicant to the 50% approval of ownership requirement to a horizontal well unit as stated in OCC-OAC 165:5-7-6(h).
IT IS ORDERED that this Cause be referred to an Administrative Law Judge for hearing, taking of evidence, and for reporting the findings and recommendations to the Commission.
IT IS ORDERED AND NOTICE IS HEREBY GIVEN that this Cause will be heard before an Administrative Law Judge on the Initial Hearing docket at the Corporation Commission, 201 W. 5th St., Suite 540, Tulsa, Oklahoma, at 8:30 a.m. on the 5th day of January, 2026, and that this Notice be published as required by law and the rules of the Commission. That the permitted well location under this order is anywhere within the unit, but no closer than 660 feet to the unit boundary.
NOTICE IS FURTHER GIVEN that the lands adjacent to Sections 23, 26 & 35 towards which this well is moving is Sections 14, 15, 22, 27 & 34, Township 19 North, Range 21 West and Sections 2 & 3, Township 18 North, Range 21 West, all in Ellis County, Oklahoma and the Hunter 1-15, Hunter 1-27, Dennett 2-34, Baker 1, Baker 2-3 and Jackson 1-23 wells.
NOTICE IS FURTHER GIVEN that Applicant’s proposed location may be closer than 600 feet to the Jackson 1-23 well and Applicant requests an exception to OAC Rule 165:10-3-28(c)(2)(b). Applicant should therefore be granted an exception to OAC Rule:165: 10-3-28(c)(2)(b) in order that Applicant’s proposed well may be situated closer to the Jackson 1-23 well, than as specified in the rules.
NOTICE IS FURTHER GIVEN that the Application in this cause states that there is currently pending before the Commission in Cause CD No. 2025-003968T, an application requesting the Commission approve the multi-unit horizontal well proposed herein and to establish a proper allocation factor for allocating the cost of, production from and proceeds from such multi-unit horizontal well to each of the units affected thereby.

Granting such other and further relief as may be proper basis upon the evidence presented at the hearing herein. The legal descriptions of the land sections adjacent to the area within which the location exception lies is Sections 14, 15, 22, 27 & 34, Township 19 North, Range 21 West and Sections 2 & 3, Township 18 North, Range 21 West, all in Ellis County, Oklahoma. NOTICE IS HEREBY GIVEN that the Applicant in this Cause is requesting the pooling of all oil and gas interests in the Cherokee common source(s) of supply in the 640-acre horizontal drilling and spacing unit consisting of Section(s) 9, Township 16 North, Range 24 West, Ellis and Roger Mills Counties, Oklahoma, adjudicating the rights and equities of the oil and gas owners thereof and designating Mewbourne Oil Company, or some other party, as operator of the unit well.
NOTICE IS FURTHER GIVEN that the Applicant in this Cause is requesting the following special relief:
(a) The Applicant shall request at the hearing that the Order provide that any owner electing an alternative to participation in the well drilled thereunder shall be deemed to have relinquished all of its working interest and right to drill in the unit and common sources of supply named herein as to such well and any wells drilled subsequent thereto.
(b) The Applicant may propose that the Order to issue in this Cause provide a method for proposal of subsequent wells, including multiunit horizontal wells; and, for response to that proposal by owners who elect to participate in the initial well.
(c) At the hearing the applicant may request that the Order to issue in this Cause provide to the operator a period of one (1) year from the date of the Order in which to commence operations for the drilling of the initial well proposed hereunder.
(d) The Applicant may also propose that parties electing not to participate in subsequent wells drilled hereunder be limited to a specific option for bonus and royalty in lieu of participation.
(e) Applicant may request that said Order be made effective on a date prior to its signing.

If an objection is filed prior to the hearing, the Court will determine at the hearing whether summary proceedings are appropriate, and, if so, whether the will on file herein shall be admitted to probate, whether the estate will be distributed and to whom to the estate will be distributed.
